Plot of 656 m2 Quiet area Altitude 518m2 Scattered Building Areas Article 62 - Characterization The Scattered Building Areas correspond to mixed-use areas, lacking an order from the perspective of sustainability and that guarantees their containment. Article 63 - Regime of Use and Occupation In the Areas of Dispersed Building, the following are permitted: a) Detachment operations, under the terms of the law, provided that the resulting buildings border on public access and provided that there are no plots with an area of less than 400 m²; b) Conservation, reconstruction, alteration and expansion works of existing buildings, regardless of their use; c) New constructions for housing, which may, on the ground floor, house the compatible uses of commerce and services; d) The construction of works intended for all other compatible uses, in accordance with the provisions of article 46 of this Regulation. The construction of single-family housing is allowed, in the detached or semi-detached typologies. In the prominent operations, the urban parameters defined in this regulation are mandatory for the area where they are located. Only construction in adjoining buildings with public access is allowed. Allotment operations are not allowed, except in the situations provided for in the RJUE regarding tourist developments. The constructions and actions referred to in this Section, and in a protected area of the Madeira Natural Park, are subject to a binding prior opinion of the Regional Secretariat responsible for the management structure, in accordance with the legislation in force and without prejudice to other applicable provisions. Article 64 - Buildability The compatible uses referred to in paragraph e) of paragraph 1 of article 60 of this Regulation must comply with the parameters defined in article 47, with the exception of paragraph 10. All buildings in Dispersed Building must comply with the constraints referred to in article 48 of this Regulation. The constructions referred to in paragraphs b) and c) of number 1 of the previous article must comply with the following buildability parameters: a) Buildings with an area of less than 1000 m²: i) Maximum Land Use Index: 0.5; ii) Total construction area: 300 m²; iii) Total height of the building, maximum value: 10m; iv) Height of the building, maximum value: 8.5m; v) Maximum height of the façade, maximum value: 7m; vi) Maximum soil waterproofing index: 50%; vii) Minimum lateral and rear clearances: 3m; b) Buildings with an area equal to or greater than 1000 m²: i) Maximum Land Use Index: 0.7; ii) Total construction area: 400 m²; iii) Total height of the building, maximum value: 10m; iv) Height of the building, maximum value: 8.5m; v) Maximum height of the façade, maximum value: 7m; vi) Maximum soil waterproofing index: 50%; vii) Minimum lateral and back clearances: 3m. For residential, local commerce and service uses, the setback of the construction to the axis of the access structure on municipal paths or roads will be, whenever possible, 6 m to the access axis, of which 3 m is intended for the carriageway. In local commercial uses, facilities for handicraft activities or spaces for the enhancement of local products, the Maximum Soil Waterproofing Index is 60%, and may be increased by 10%, if necessary to comply with the provisions of Annex II to this Regulation. ;ID RE/MAX: 123511098-110
