MAYOR OF THE CITY OF PASYM
announces the first unlimited oral tender
for the sale of a land property developed with a building of a former village common room in the village of Narajtyz with shares in adjacent properties, marked in the land register of the Narajty precinct, Pasymjako commune, plots:
- No. 78/9 with an area of 0.0390 ha with shares: 304/1000 part in plot No. 78/4 with an area of 0.0297 ha and 304/1000 part in plot No. 78/8 with an area of 0.0159 ha – the starting price is PLN 50,000.00 net
The sale of real estate is exempt from VAT on the basis of Article 43(1)(10) of the Value Added Tax Act.
The premises of the village common room in the town of Narajty with a usable area of 139.3 m2, consisting of 4 utility rooms, located on the ground floor of a residential and commercial building, located on plots 78/4, 78/8 and 78/9, obr. geod. Narajty. The year of construction of the building in which the common room is located – around 1930. The District Court in Szczytno keeps the following land and mortgage registers for the above-mentioned real estate: KW No. OL1S/000246.../5 (for plot 78/4 and plot 78/8), for non-residential premises No. 3 - KW No. OL1S/00049201/0 and OL1S/00031757/3 (for plot 78/9). The common room is equipped with an electrical installation. The facility is in a deteriorated technical condition, it requires a major renovation. A water supply connection runs through plots No. 78/4, 78/8 along the border with plot No. 78/7. A telecommunications line runs through plot No. 78/9 (from the yard). Along the road through plots No. 78/4, 78/8, 78/9, the designed sewage network is planned. The candidate for the purchaser of the real estate will be obliged to consent to make the real estate available for the time of construction of the sewage network and to establish a free-of-charge transmission easement for an indefinite period of time on the real estate consisting in each time making the real estate available for the purpose of maintenance, repairs, removal of failures, replacement, modernization and other operational activities for the benefit of the Pasym commune. The easement will be entered in the Land and Mortgage Register.
Currently, there is no local spatial development plan for the area where the above-mentioned plots are located. No decision on development conditions has been issued for plot No. 78/9. In the land register, the plots are classified as B. The premises of the common room are located on plots located in the precinct of S. geod. Raiders marked with registration number:
- 78/4 with an area of 0.0297 ha (share in the ownership of the Pasym Commune 304/1000),
- 78/8 with an area of 0.0159 ha (share in the ownership of the Pasym Commune 304/1000),
- 78/9 with an area of 0.0390 ha (share in the ownership of the Pasym Commune 1/1).
The sale of the property will include the sale of plot No. 78/9 in the share of 1/1 together with the share in part 304/1000 vested in the ownership right to plots No. 78/4 and 78/8.
The real estate which is the subject of the tender is not encumbered with limited property rights and is not subject to obligations and there are no legal obstacles to its disposal. The seller sells the property in accordance with the extract from the land and building register and the map issued by the Starost of the Szczytno District. Showing the boundary points of the real estate can take place at the request and at the sole expense of the Buyer. The buyer takes over the property in its existing state.
The tender for the sale of the above-mentioned real estate will take place on 25.07.2025 in room 7
of the Pasym Town and Commune Office at 11:00 a.m.
The tender may be participated by natural persons, legal persons and other entities who will pay a deposit in money in the amount of 10% of the starting net price to the account of the Town and Commune Office of Pasym in Bank Spółdzielczy Szczytno, Pasym Branch No. 32 8838 1060 2009 0600 0101 0003 by 18.07.2025 with the plot number marked. The tender deposit should be paid in advance so that the funds are on the account of the Pasym Town Hall by 18.07.2025 at the latest. - under pain of recognition by the tender organizer that the condition of payment of the tender deposit has not been met.
Participants of the tender should submit to the tender committee:
• proof of payment of the tender deposit,
• a statement on familiarizing yourself with the factual, formal and legal status and the state of development of the real estate of the subject of the tender and not raising any objections on this account,
• a statement of having read the terms and conditions of the tender and accepting them without reservations
• in the case of natural persons – an identity document (identity card or passport), and in the case of representing another person, additionally a power of attorney,
• in the case of legal persons or organizational units without legal personality – an extract from the National Court Register (in the case of an entity not entered into the National Court Register, a current document confirming the status of this entity, drawn up no earlier than one month before the tender), and if the participant of the tender is a person conducting business activity – a certificate of entry in the register of business activity and an identity document of persons representing the entity; in the case of proxies – an identity document and powers of attorney authorizing the representation of the entity,
• in the case of partners in a civil law partnership – identity documents of the partners, articles of association of the civil law partnership, and in the case of proxies – an identity document and powers of attorney authorizing the representation of the entity,
• in the case of natural persons who are married, in the case of participation in the tender of one of the spouses, they are obliged to submit a power of attorney granted by the absent spouse to pay the bid bond, participate in the tender on his/her behalf and make statements related to the tender. In accordance with Article 37 of the Act of 25.02.1964. Family and Guardianship Code (i.e. Journal of Laws of 2023, item 2809), the consent of the other spouse is required to perform a legal act leading to a paid acquisition in the case of statutory community. The validity of an agreement that has been concluded by one of the spouses without the required consent of the other spouse depends on the confirmation of the agreement by the other spouse. In the case of separation of property, an appropriate document must be presented. Married persons intending to purchase real estate from separate property are obliged to submit an appropriate statement.
Templates of the above-mentioned declarations are available at the seat of the Town and Commune Office in Pasym, 8 Rynek Street, 12-130 Pasym, room 14 during the working hours of the Office and on the website in the Public Information Bulletin kept by the Town and Commune Office of Pasym, .pl.
The tender deposit paid by the tender participant who won the tender will be credited towards the purchase price. The price achieved in the tender, after the bid bond has been credited, will be payable once no later than on the date of concluding the notarial agreement. On the day of signing the notarial agreement, the funds should be on the bank account of the Pasym Commune. The purchaser of the real estate will be notified of the date and place of concluding the sale agreement within 21 days from the date of the tender settlement. The property will be handed over with the signing of a notarial deed. The buyer takes over the property in its existing state. The person appointed as the buyer bears the notarial and court costs related to the notarial agreement. Failure of the buyer determined in the tender to conclude the notarial agreement will result in the seller's withdrawal and the loss of the deposit paid.
The tender is valid regardless of the number of participants, if at least one of them offers a price higher than the starting price by at least one increment. The increment cannot be less than 1% of the starting price, rounded up to full tens of zlotys. The amount of the increment is decided by the participants of the tender. The tender deposit will be returned to the other participants immediately, but not later than within 3 days from the date of completion of the tender.
The right to cancel the tender for a justified reason is reserved.
